Sen. John Cornyn (R-TX) floored an amendment to ban all felons, as well as illegal immigrants, already ordered to be deported from receiving a Z-Visa. While it would seem like common sense to prevent these criminals from gaining permanent legal status, the amendment was defeated by a vote of 51-46.

Ten Republicans voted against the measure that was introduced in order“to establish a permanent bar for gang members, terrorists, and other criminals.” The most notable party defectors on this amendment were Sen. John McCain and Sen. Lindsey Graham, who chose to side with Sen. Ted Kennedy. According to a report from the AP, Kennedy said, “it would exclude hundreds of thousands from the benefits in this bill and undermine the bipartisan compromise that (senators) worked so long and so hard to produce.”

Personally I believe anybody who has not only come into out country illegally, but has also committed felony crimes in our country or their own nation have no business being allowed to legally stay in America on a permanent basis.

Democrats and a handful of Republicans were able to kill Cornyn’s amendment, which was co-sponsored by Sen. Jim DeMint, by proposing a more limited amendment that would prevent gang members and sex offenders from receiving the Z-Visa. But this amendment still allows people to receive the Z-Visa even if they have been convicted of other crimes like identy theft.

Opponents of the Cornyn amendment cited that their concerns with this proposal were soley based on fears that it would kill the entire bill. But one must wonder why they sacrificed public safety just so they can ram this awful piece of legislation down the throats of the American people.

    * Any felony
    * Any three or more misdemeanors
    * Any serious criminal offense
    * Crimes involving moral turpitude (with narrow exceptions for certain misdemeanors such as those committed before age 18)
    * Violations of a law relating to a controlled substance

    If the Immigration Bill excludes and prevents felons and criminals from getting Z-Visas, then why would Sen. Cornyn have felt the need to amend it to do just that? Look at Sen. Kennedy’s remarks. I am so disappointed in our Sen. Graham for voting against the Cornyn amendment! I will call his office in the morning. I wrote him a hot email this afternoon. Others should do the same!

    There was a poison pill in the Cornyn amendment.

    What Cornyn didn’t advertise was that the disqualifying crimes include things such as using false ID in order to work or being deported once and then returning. It was estimated that this would have disqualified 8 million of the 12 million. Knowing that they would get deported if the bill passed and they voluntarily came out of shadows, they would have simply stayed in the shadows. Cornyn’s real intent was to gut the bill.

    That’s why Kennedy had an alternative amendment that PASSED EASILY, and that was very similar to Cornyn except that it removed the ID and previous deportation crimes from the list. It covers rape, assault, terrorism, etc. just as Cornyn would have.

    Don’t be tricked by these guys. Cornyn is against he bill and all his amendments contain poison pills that he won’t tell you about. Then others who oppose the bill (radio hosts, bloggers, etc.) will demagogue those amendments in collusion with him.

    Bottom line: Kennedy passed, and so rapists, etc. would be deported.

    Don’t you think identy theft is a serious crime. How many hard working American citizens do believe felt repercussions because somebody stole their identity to get jobs, open bank accounts, and most importantly credit cards. Some of these people would even get utility bills in the names of the identities they stole and when they couldn’t pay theses bills it messed up other people’s credit.

    Why should people who have destroyed the credit of hard working American citizens be able to get Z-Visa’s?

    I mean this is something that affects people’s chances of being able to get a home loan, car loan, and credit cards.

    Ever think that there is a good reason Cornyn and DeMint oppose this bill?

    You have got to be kidding, KD? The Cornyn amendment would have barred felons like- sex offenders, drug dealers, repeat dui’s, from getting the z-visa. It would have also barred those who openly defied court orders to LEAVE our country and those who have forged and falsified id’s and other documents to undermine OUR laws. I don’t care how many are guilty of that, get rid of them all. Do you really think that arguing that too many are guilty of that is a valid argument?

    And, I don’t care if Cornyn’s intent was to gut the bill. The bill need’s to be gutted. It needs to be eviscerated. Good for senator Cornyn!

    Good for Senator Cornyn! Lindsay Graham is wrong. John McCain should not be the Republican candidate for President.
